House and site rules
for the ‘Open House’ event organised by the company
SW-Motech GmbH & Co. KG
1.0 Scope
a) The house and site rules apply to all areas of the event venue, i.e. to all halls, outdoor areas and all buildings and land that have been made available to SW-Motech (hereinafter referred to as SW) on a temporary or permanent basis for the purpose of the event, regardless of whether these are private or public areas or buildings. They apply to all persons who enter or remain on the event premises as visitors or exhibitors.
b) SW exercises its domiciliary rights in all the above-mentioned areas through its employees and/or through employees of security companies commissioned by SW. The instructions of the security personnel must be followed at all times.
2.0 Arrival, parking, admission and access to the premises
a) Travel to the venue is at your own risk and expense. Before setting off, you must obtain information about the traffic situation, the staging of the event and any restrictions in good time.
b) Parking is at your own risk and is only permitted in designated areas. Emergency routes and areas for the fire brigade (detours, staging and manoeuvring areas) must be kept clear at all times. The owner/holder is liable for damage without proof of fault. Vehicles, etc. that have been parked illegally will be impounded, moved or towed away at the expense of the owner/holder or the person responsible for the disturbance. The StVO (German Road Traffic Regulations) apply on public and private areas provided by SW as parking spaces. The instructions of the security service must be followed.
c) SW reserves the right to make individual parts or the event itself accessible only to invited guests or to adjust the conditions of access (e.g. age) at short notice and without prior notice.
d) SW employees or employees of security companies commissioned by SW who can identify themselves as such are entitled to carry out ID checks on the event premises. Security and bag checks may be carried out at the entrance or during the event.
e) The premises may only be accessed during the specified opening hours. Deviating access regulations – in particular for exhibitors and service partners of SW – remain unaffected by this.
f) Children under the age of 6 are not permitted to attend evening events, even when accompanied by a parent or guardian. Children and young people between the ages of 6 and 14 will only be admitted when accompanied by a parent or guardian.
g) We request that appropriate clothing be worn for protection against bad weather.
3.0 The event
a) SW reserves the right to change the programme and the offer, or to cancel or interrupt the event without prior notice.
b) The instructions of the security personnel must be followed. Failure to do so may result in expulsion from the event premises.
c) Publicly accessible areas are marked accordingly. Internal areas may not be entered by persons not authorised to do so without permission.
d) It is prohibited to bring bulky items, pyrotechnic items, torches, sparklers, weapons, unmanned aerial vehicles (drones), similarly dangerous items and dangerous animals.
e) Test drives are always at your own risk and in accordance with the rules of the respective provider. There is no entitlement to test drives. The Road Traffic Regulations (StVO) apply.
f) Image, sound or image and sound recordings may be made at the event for advertising purposes. By entering the premises, you expressly consent to publication and evaluation and transfer the necessary rights for evaluation free of charge. SW accepts this transfer.
g) Food and beverages are provided by and at the risk of the respective stand operators.
h) Any behaviour that is likely to disrupt the proper running of the event, the set-up and dismantling, or that otherwise violates the interests of SW is prohibited, including but not limited to
- any unauthorised commercial activity on the event premises, in particular the offering of goods and services of any kind, whether for payment or free of charge;
- the unauthorised distribution or display of flyers, advertising material, posters, magazines, etc., as well as the affixing of stickers of any kind;
- the contamination of the premises, the illegal disposal of waste, bringing waste onto the exhibition grounds, as well as any behaviour that is likely to pollute or endanger the environment;
- unauthorised entry of vehicles onto the event premises and the unauthorised use of vehicles on the exhibition grounds;
- the use of scooters, Segways, kickboards, roller skates, inline skates, skateboards and similar means of transport with or without a motor on the entire exhibition grounds;
- the consumption of drugs and excessive consumption of alcohol;
4.0 Liability and compensation
a) SW shall only be liable for damages – regardless of the legal basis – in cases of intent or gross
negligence. In cases of simple negligence, liability shall be limited to:
- Damage resulting from injury to life, limb or health
- Damage resulting from the breach of an essential obligation of the organiser (obligations whose fulfilment is essential for the proper execution of the event and on whose fulfilment the organiser can rely); in this case, however, liability is limited to compensation for the foreseeable, typically occurring damage. Liability for indirect or consequential damage that is not typical for the contract is excluded.
b) SW shall not be liable for items lost or stolen during the event.
c) Due to the volume of some parts of the event, there is a risk of hearing damage and damage to health. SW accepts no liability for this and advises against attending the event if you have any concerns.
d) Insofar as SW's liability is excluded or limited, this also applies to the personal liability of SW's employees, representatives and vicarious agents.
5.0 Final provision
In the event of violations of the house rules or other provisions of SW, SW is entitled to issue a warning, a
temporary or permanent ban from the event premises. Violations of the house rules may result in
exclusion from participation in the current event or from participation in future events. Criminal
prosecution is not excluded by the measures specified in these house rules.
